Tank set to run dry for city petrol stations' booze sales

PETROL stations across the city are set to lose the right to sell alcohol because of a new council policy.
At a licensing meeting this week, two BP garages – both of which sell alcohol under a section run by Marks & Spencer – had their right to sell drink removed.

Councillors say the decision was not because of any concerns about the business but becau
se of new Scottish Government legislation which will not come into force until September next year.

It states that councils are allowed to deny petrol stations and garage forecourts the right sell alcohol unless there is a specific need for it, for instance if it is in a remote location.

The two petrol stations – at Slateford Road and Builyeon Road, South Queensferry – will now have to stop selling alcohol unless the decision is appealed, even though the sales of drink in both are strong.

A council source told the Evening News: "The policy is plainly there to be used and the M&S lawyers weren't very happy about it, but if policy isn't used then there's no point in it being made in the first place.

"The act states quite clearly that they should only sell alcohol if there is a specific need for it."

Another council insider added: "It's fair to say that the licensing board will continue to follow the letter of the act in this manner."

This has led to fears petrol stations across the city will be forced to relinquish their licences.

Licensing leader Councillor Marjorie Thomas said: "The board was unanimous in its decision to refuse these licences as it was clear that garages should be excluded from selling alcohol unless they are the only amenity in an area. This was clearly not so in these cases."

The approach has not gone down well with the Edinburgh Chamber of Commerce, which warned this could be the last straw for petrol stations.

Spokesman Graham Bell said: "Delivering fuel from the pump to someone's tank is not profitable any more for petrol stations, and in order to survive they have to become like a supermarket, using fuel as the draw to other items, and alcohol sales make up a big part of that.

"If that is taken away we could see more having to close."

Almond councillor Norman Work, who also sits on the licensing board, said he did not think it would be long before all petrol stations would be banned from selling alcohol.

"I've always wondered why garages have sold alcohol anyway," said the SNP councillor. "I think the idea is a bit like promoting drink driving."

Both BP and Marks and Spencer declined to comment.

Is there actually any establishment that "needs" to sell alcohol?

Utter waste of time. Where else can the local blue-rinse brigade get a hold of a nice bottle of M&S branded chardonnay?

Take away the licences from the family run corner stores if you really want to make a difference.

Nice to see that the council is leading the way by using a law which doesn't come into force until next year.

The companies' lawyers will have a field day.

They've only done this because they've realised that Vodka's cheaper than petrol, and it's driving the customers to drink.

The puritanical brigade strike again. This is a very short sighted policy that is likely to see only supermarket petrol stations survive. Myopic stupidity.

I've always wondered why on earth you need alcohol on sale in a petrol station - oh yes, profit...

...as if the petrol companies weren't making enough on fuel

#3 alcohol has a wide variety of industrial applications. It's used in steak & ale pie, 'forced induction' combustion engines, as a solvent, and it's always been used by journalists for a Lunchtime Libation.

But you're right nobody 'has' to sell alcohol in much the same way as nobody has to sell:

bauxite
all day breakfast in a tin
The EEN
Millwall replica shirts
Space Shuttle maintenance contracts

Yeh it's a bit like when R&B songwriters put random words together for the sound rather than the meaning:

a bit like Des'Ree's lyrics for the song 'life'

"I don't want to see a ghost/It's the sight that I fear most/I'd rather have a piece of toast/ and read the evening news"

Bemused and above it all,

Can councils not just revoke a liscence anyway?
Never realised they needed a reason, lets behonest.
If a pub landlord had regulars constantly nicked for drink driving, his liscence in all liklihood would be revoked at next renewal as the cops would point out the rates around the area, why not just do it and say its to do with drink driving instead of leaving themselves open to getting sued for discrimination?

BREAKING NEWS...........................

A new law, not in force until 2012, is being implemented by the cooncil very soon. A ban well force petrol stations, supermarkets, shops and pubs, in fact everywhere; to stop selling chocolates, sweets and non diet drinks until there are no fat people left in the country. A fat cooncillor (is there any other kind?) said, "we want to be ahead of the game, and the only places that will be permitted to sell these items will be funeral directors (and then only to clients) and chimney sweeps."

It does seem unfair that these two businesses will suffer from being singled out for what seems like a weak arguement. I've not seen too many middle aged folk on a drunken rampage, high on Markies Cabernet Sauvignon.
