A SHERIFF yesterday expressed his sympathy for a 62-year-old man who grew his own cannabis to alleviate chronic back pain.
Sheriff Derek Pyle told Alexander Mearns: "The court and prosecution authorities, and the police, have to enforce the law as it stands, not as what some think it ought to be, I am afraid. I have considerable sympathy for you."
Inverness Sheriff Court was told Mearns had twice battled cancer, survived a heart attack, had diabetes, suffered chronic back pain and had a twisted spine.
Mearns, of Inverness, was found to be producing cannabis at his home on 13 January.
Police officers found six plants growing and a further ten small cuttings.
The retired post office worker admitted two charges of producing cannabis and possessing the drug.
Sheriff Pyle fined him £300 for producing the drug, and admonished him on the charge of possession.
